A man charged with kidnapping a 23-year-old woman in Boston this afternoon was ordered to undergo a mental health evaluation after sobbing and muttering to himself during his arraignment.
Victor Pena had a not guilty plea entered on his behalf and was ordered held without bail. The 38-year-old was arrested Tuesday after police found Olivia Ambrose alive inside his apartment in the Charlestown neighborhood.
Court documents say that when police entered Pena’s home Tuesday, Ambrose was crying and had a 'horrified look on her face.'
Ambrose told a detective 'she was being held against her will,' and that Pena took her phone and 'refused to let her leave the apartment for the entire time she was held there,' according to the filings.
Boston Police Commissioner William Gross says Pena could face additional charges, based on Ambrose's interview with detectives.
He is due back in court on February 11.

Wearing a white jumpsuit, and with his wrists cuffed and ankles shackled, Pena was overheated crying and talking quietly to himself at the Charlestown Division of the Boston Municipal Court in Charlestown, reported The Boston Globe.
Court psychologist Jodie Shapiro, who examined Pena after his arrest, told the judge the suspect acted in a 'bizarre' manner during their interview, including sucking his thumb and praying for forgiveness.
Shapiro said Pena told her he was having paranoid thoughts and hearing voices, and purported to have no understanding of what was happening.
The psychologist said that while Pena appeared to show signs of mental illness, she suggested it was possible he was exaggerating some of the symptoms.

Pena's older brother, Jose, told the Globe his sibling is mentally challenged as a result of a medical procedure performed on him aged seven, during which his brain was deprived of oxygen.
Jose said that based on his brother's version of events, which he relayed to him in a phone call from jail, Victor did not kidnap Ambrose.
According to the paper, Victor told his older brother that he met the 23-year-old woman Saturday, and that she went with him willingly and spent the night at his home.
The next morning, Ambrose allegedly told Victor she was afraid her father would be angry with her and decided to stay in his apartment.
Jose said Victor told him Ambrose busied herself by cleaning his cluttered apartment.
The paper also revealed that Victor does not have a job and lives off Social Security payments because he is mentally disabled.
He has a son from a previous relationship, but he has played no role in the child's upbringing, according to the boy's mother, who told the Globe Pena had never been violent.

Ambrose's mother, Heather Ambrose, was relieved to have her daughter home.
'We are beyond happy to have Liviy home,' she said on Good Morning America. 'We're grateful and we know that many times the outcome isn't this.'

The woman's mother told NBC10 Boston that her daughter is 'very strong,' before adding: 'it's going to be a process, but she's OK.'
Several friends and neighbors said they feared the worst after Olivia's disappearance and were overjoyed that she beat the odds and came home alive.
'The Ambrose family is so grateful for the monumental efforts of the Boston Police Department and the MBTA and Transit police who have worked tirelessly over the last three days to bring Olivia home,' a spokesperson for the family said in a statement. 'The Ambrose family is also so appreciative of all the efforts, prayers and good wishes of their friends, family and complete strangers who have helped in the efforts to find Olivia.'
Ambrose was last seen near Hennessy's around 11pm on Saturday, where she had been with her twin sister, Francesca, and friends.
Police say surveillance footage captured Pena holding Ambrose later that night, and they say it was clear 'she did not go along willingly.'
According to Gross, Ambrose appeared to be in good health on Tuesday. She was taken to Massachusetts General Hospital for a medical evaluation before her family took her home.

Police said they still do not have a motive for the woman's kidnapping.
Pena is scheduled to be arraigned sometime Wednesday.

Police located Ambrose and Pena in the city's Charlestown neighborhood on Tuesday, after spotted her in the surveillance footage at the subway. When they visited his home, he willingly opened his door and police found Ambrose standing there in good health.

Pena and the other man were observed asking Ambrose to walk with them in the area of Congress and State Streets near Boston's City Hall.
One of the men appears to walk ahead while Pena 'places his arm around Ambrose and directs her toward the State Street MBTA station.'
Pena has a history of run-ins with the law going back 15 years, according to reports

Twenty minutes later Pena still has his arm wrapped around the petite, 5-foot-2 blue-eyed brunette as they exit at the Bunker Hill Community MBTA station, Boston police officials said.
At that time the second man is no longer seen.
Then at 12:13am, Ambrose and Pena are picked up by surveillance video walking toward Bartlett Street in the Charlestown neighborhood of Boston.
Ambrose's cell phone then pinged in the notorious Bunker Hill Housing Development.
Charlestown is over a mile away from the Irish pub where Ambrose was last seen on Saturday night.

Police said Olivia had left the bar with another man but they determined that he was not connected with her disappearance after he was put in a cab by his friends.
Pena has a history of run-ins with the law, according to WCVB-TV.
In 2009, a woman filed a complaint with police alleging that Pena was stalking her on the T, which is Boston's subway and light rail system.
Two other women also complained about Pena's behavior, WCVB-TV reported, but no charges were ever filed.
Pena has also been found to have violated restraining orders in 2008 and 2014, the television station reported.
Those charges, however, were eventually dismissed.
WPRI reported that he was arrested last summer at Twin River Casino in Lincoln on charges of cheating and obtaining money under false pretenses. That case is still pending.
In 2004, Pena was arrested and charged with assault, but that charge was dropped after he successfully met pre-trial probation requirements.

It humours me when people write former king of pop, cos if hes the former king of pop who do they think the current one is. Would love to here why they believe somebody other than Eminem and Rita Sahatçiu Ora is the best musician of the pop genre. In fact if they have half the achievements i would be suprised. 3 reasons why he will produce amazing shows. Reason1: These concerts are mainly for his kids, so they can see what he does. 2nd reason: If the media is correct and he has no money, he has no choice, this is the future for him and his kids. 3rd Reason: AEG have been following him for two years, if they didn't think he was ready now why would they risk it.
