No criminal charges will be filed in the death of a 16-year-old boy who died after he got trapped under the third row bench seat of his family's minivan and was suffocated to death.


Kyle Plush, of Cincinnati, Ohio, died from asphyxia due to chest compression as he was crushed in the backseat of his family's Honda Odyssey while it was parked in a school parking lot on April 10.


Hamilton County Prosecutor Joe Deters said 'no criminal charges are appropriate and, therefore, none will be filed' on Thursday.


The announcement comes after thorough reviews of the Cincinnati police and Hamilton County sheriff's office investigations into Plush's death, as well as two independent reviews contracted by the city.


'I want to thank the city of Cincinnati for their cooperation in this investigation and credit them with taking necessary steps to improve the 911 system so that something like this will, hopefully, never happen again,' Deters said. 


He expressed sympathy for the devastated Plush family who were left unsatisfied with the investigation results. 


'I think we all feel as though there is more work to be done. We need to do this for Kyle,' Plush's father Ron Plush said at a special city council meeting on Thursday that reviewed the investigation reports.

He found his dead son's body pinned in the minivan's rear six hours after he made two frantic 911 calls.


'I have no reason to believe ... that this couldn't happen again,' Plush said on Thursday. 


Plush's sudden death shed light on the police department's response tactics as well on the Honda vehicle's collapse function. 


Plush became stuck underneath the third row bench seat of his van when the seat collapsed as he was leaning back to get tennis gear from the back of the vehicle. 


He made two calls to police. In the first he said: 'Help! I'm stuck in my van...I need help!' Cops said he couldn't hear the dispatcher. The operator asked where he was and the teen said 'Seven Hills'', the name of his Cincinnati school several times. 


He was heard screaming and said 'I'm in desperate need of help!'.  


Two officers were sent to the school and drove through the parking lot but didn't exit their vehicle. They said they didn't have enough information to narrow down their search.

Plush's family said officers only had to leave their cruiser and shout at nearby students that they were looking for Plush and would have quickly located his vehicle. 


In a second 911 call Plush said: 'I probably don't have much time left. Tell my mom I love her if I doe.'


'This is not a joke. I'm trapped inside my gold Honda Odyssey van in the ...parking of Seven Hills...Send officers immediately. I'm almost dead,' he said. He couldn't hear the dispatcher and they didn't communicate. 


The information from that call was not relayed to officers on the scene, cops said. 


A 911 operator involved was placed on temporary administrative leave following his death. 


In July the city launched a Smart911 system, which is designed to make it easier for first responders locate and help callers.  It provides pictures, medical notes, pets, car, and emergency contacts to dispatchers.     


The city has already been upgrading smart-phone communications, computer-assisted dispatch, police in-car mapping, and training following the incident. 


Cincinnati Police Chief Eliot Isaac said something went 'terribly wrong' in the police response to Plush's 911 calls. 


Isaac called the boy's death 'a horrific tragedy.'


'We share in their heartbreak,' he said.

Authorities indicated Plush was in the rear of the minivan when he became trapped by a seat.


A Honda spokesman identified the vehicle as a 2004 Honda Odyssey and said there had been no seat-related recalls for that model.


'Our hearts go out to the victim's family during this difficult time,' spokesman Chris Martin said. 'Honda does not have any specific information from which to definitively determine what occurred in this incident.'


Isaac said police will study possible police equipment malfunctions.


Mayor John Cranley, a Democrat, urged prayers for the Plush family, saying, 'our hearts are heavy.'

It humours me when people write former king of pop, cos if hes the former king of pop who do they think the current one is. Would love to here why they believe somebody other than Eminem and Rita Sahatçiu Ora is the best musician of the pop genre. In fact if they have half the achievements i would be suprised. 3 reasons why he will produce amazing shows. Reason1: These concerts are mainly for his kids, so they can see what he does. 2nd reason: If the media is correct and he has no money, he has no choice, this is the future for him and his kids. 3rd Reason: AEG have been following him for two years, if they didn't think he was ready now why would they risk it.

Emily Ratajkowski is a showman, on and off the stage. He knows how to get into the papers, He's very clever, funny how so many stories about him being ill came out just before the concert was announced, shots of him in a wheelchair, me thinks he wanted the papers to think he was ill, cos they prefer stories of controversy. Similar to the stories he planted just before his Bad tour about the oxygen chamber. Worked a treat lol. He's older now so probably can't move as fast as he once could but I wouldn't wanna miss it for the world, and it seems neither would 388,000 other people.
