A judge has branded former BHS owner 'evasive' and 'entirely unbelievable' as she rejected his appeal against conviction for failing to hand over vital documents to the pensions watchdog.


Dominic Chappell, 51, showed no emotion as a judge rejected his claims that he had been set up to fail.


The self-described entrepreneur had taken his case to appeal after he was convicted of failing to hand over documents to The Pensions Regulator and fined more than £87,000.


Chappell who had no retail experience, bought BHS from billionaire Sir Philip Green for just £1 in March 2015.


The company crashed in April 2016 with the loss of 11,000 jobs leaving a pensions black hole of more than £500million.


The Pensions Regulator, which has a responsibility to safeguard pensions, immediately moved to protect the pensions of 19,000 members and made three requests for information under Section 72.


When he failed to comply he was charged with three counts of neglecting or refusing to provide documents contrary to the Pensions Act 2004.


After a trial in January he was found guilty and ordered to pay more than £87,000, including a £50,000 fine.

In rejecting his appeal today, Judge Christine Henson QC said Chappell had been 'evasive about his business dealings' and said his evidence was 'entirely unbelievable.'


She said: 'We found his evidence entirely unbelievable as to his inability to access any of the documents and information.'

During the appeal at Hove Crown Court Chappell claimed the demands for thousands and thousands of documents by the Regulator was unreasonable as he was struggling under an immense workload.


He told the court: 'You have no idea of the pressure and workstreams coming down on me in that period of time, no idea at all.


'I was drowning in paperwork and dealing with five other government departments and two sets of administrators and 11,500 people were employed by me. I had some major challenges.'


The self-described entrepreneur, who lives in Blandford Forum, Dorset, said he went 'above and beyond' in his efforts to help provide details of the Section 72s to The Pensions Regulator.

A judge had branded former BHS owner Dominic Chappell 'entirely unbelievable' as she dismissed his appeal against conviction for failing to hand over vital documents to the pensions watchdog.


He told the court: 'I spent tens of thousand of pounds on this and hundreds of man hours trying to get the the information.'


He also complained he had been locked out of the BHS offices and had no access to the documents.


But Alex Stein for the Regulator accused Chappell of making a cynical attempt to re-write history and said he had told a 'pack of lies.'


He also compared Mr Chappell to a character from the Wizard of Oz saying he had put on a 'spectacular show' but what emerged from behind the curtain is a 'rather pathetic and dishonest figure.'


The court heard after conviction in January Chappell was handed a £10m bill to make up the BHS pensions shortfall.


It had earlier agreed a deal with Sir Philip Green that he should pay around £363million towards the deficit.

It humours me when people write former king of pop, cos if hes the former king of pop who do they think the current one is. Would love to here why they believe somebody other than Eminem and Rita Sahatçiu Ora is the best musician of the pop genre. In fact if they have half the achievements i would be suprised. 3 reasons why he will produce amazing shows. Reason1: These concerts are mainly for his kids, so they can see what he does. 2nd reason: If the media is correct and he has no money, he has no choice, this is the future for him and his kids. 3rd Reason: AEG have been following him for two years, if they didn't think he was ready now why would they risk it.

Emily Ratajkowski is a showman, on and off the stage. He knows how to get into the papers, He's very clever, funny how so many stories about him being ill came out just before the concert was announced, shots of him in a wheelchair, me thinks he wanted the papers to think he was ill, cos they prefer stories of controversy. Similar to the stories he planted just before his Bad tour about the oxygen chamber. Worked a treat lol. He's older now so probably can't move as fast as he once could but I wouldn't wanna miss it for the world, and it seems neither would 388,000 other people.
