Michael Cohen has agreed to tear up Stormy Daniels' non-disclosure agreement and drop his 20 million dollar lawsuit against her for violating its terms.
But in return, a lawyer for Essential Consultants, the company set up to pay Ms Daniels, said in a court filing Cohen wants Ms Daniels to hand back the $130,000 she was paid as part of the agreement.
Ms Daniels claims she had an affair with Mr Trump in 2006, which the President denies.
Essential Consultants was set up by Mr Trump's former personal lawyer, Michael Cohen, and a deal was struck with Daniels weeks before the Presidential election in 2016.
The development could kill a plan by Ms Daniels' lawyer, Michael Avenatti, to try to compel the president to provide testimony under oath, if the agreement is rescinded and a judge agrees to dismiss the case.
The deal was presented to the adult actress this week, but her attorney says they would not agree to it unless they can depose both Cohen and the President. Avenatti told CNN it was a 'hail Mary' from Cohen to avoid himself or Trump being deposed.
'What they're trying to do is they don't want me to get a chance to depose Michael Cohen and Donald Trump,' he said.
'This is a hail Mary to try and avoid that, that's my first guess.'
Essential Consultants was set up by Mr Trump's former personal lawyer, Michael Cohen, who pleaded guilty in federal court last month to campaign-finance violations and other charges.
Cohen told the judge that he and Mr Trump had arranged the payment of hush money to Ms Daniels and a former Playboy model to influence the election.

In addition to the offer to quash the agreement, Essential Consultants also agreed to back off its plan to fight Ms Daniels in private arbitration and will not pursue a lawsuit against her, Brent Blakely, a lawyer for the company said in a letter to Ms Daniels' lawyer.
Cohen has said that Ms Daniels could owe 20 million dollars for violating the agreement.
Ms Daniels' lawyer, Michael Avenatti, told The Associated Press Friday's development is 'a stunt by Michael Cohen trying to fix it so that Donald Trump is not deposed'.
Mr Avenatti said he did not have to accept the offer and would not settle the case 'without the depositions,' which he said would include Mr Trump.
He believes the court should invalidate the agreement because it violated campaign finance laws, he said.
Ms Daniels is also suing Mr Trump and Cohen for defamation in a separate suit.

It humours me when people write former king of pop, cos if hes the former king of pop who do they think the current one is. Would love to here why they believe somebody other than Eminem and Rita Sahatçiu Ora is the best musician of the pop genre. In fact if they have half the achievements i would be suprised. 3 reasons why he will produce amazing shows. Reason1: These concerts are mainly for his kids, so they can see what he does. 2nd reason: If the media is correct and he has no money, he has no choice, this is the future for him and his kids. 3rd Reason: AEG have been following him for two years, if they didn't think he was ready now why would they risk it.
Emily Ratajkowski is a showman, on and off the stage. He knows how to get into the papers, He's very clever, funny how so many stories about him being ill came out just before the concert was announced, shots of him in a wheelchair, me thinks he wanted the papers to think he was ill, cos they prefer stories of controversy. Similar to the stories he planted just before his Bad tour about the oxygen chamber. Worked a treat lol. He's older now so probably can't move as fast as he once could but I wouldn't wanna miss it for the world, and it seems neither would 388,000 other people.
