Financier Shele Danishefsky approached an attorney at her New York Upper West Side synagogue to cut her backgammon pro husband Rod Covlin out of her will just five days before Covlin allegedly strangled her, a jury heard Tuesday.


Her estate was valued at $5.4 million, prosecutors told Manhattan Supreme Court. 


Attorney Jonathan Herlands, who specializes in trusts and estates, told Covlin's murder trial at Manhattan Supreme Court Shele was with her children at the Lincoln Square Synagogue when she came up to him and asked for a consultation.


Herlands said that on Dec. 26, 2009 Shele told him, ‘I need to change my will. I want to make sure Rod doesn’t get any part of my estate’.


They were on a landing outside a social event following Sabbath services and Herlands asked her for an email address because he didn’t want to do business on the Sabbath or discuss that type of matter with other people around, he said.

Shele gave him her address at Gmail. Two days later he emailed her to test the address, explaining he was barred from carrying a pen on the Sabbath, and asked her to acknowledge receipt, a prosecution exhibit of their email exchange showed.


She replied on her UBS account the next day – two days before her death – that she had received it and wanted to know what his rates before they had a meeting ‘in the interest of making sure no one’s time is wasted’. Herlands replied he got $465 an hour, going up to $485 an hour beginning Jan 1, 2010.

Herlands then said he would need to review her current trusts and will ‘because it is not as “cut and dried” as you described your needs when we spoke briefly at shul’.


Herlands said he did not hear back from Shele, who was found dead in her bathtub two days later.


Earlier Tuesday afternoon, Hannah Pennington, an assistant commissioner at the Mayor's Office to End Domestic and Gender Based Violence, testified that while was Shele’s neighbor in their West 68th Street apartment building, Shele had confided in her she was concerned that Covlin was ‘using different ways to get information about her’.


‘She [Shele] pointed to the molding in the hallway and said she had a fear of him putting in surveillance equipment’ to monitor her, Pennington testified,


On Tuesday morning, the woman who claimed Rod Covlin raped her told the jury she realized she had been assaulted after backgammon pro Covlin whipped out a 'big bag of drugs' that had put her in a 'drug-induced coma'.

Patricia Swensen, testifying for the second day, said the revelation came during an August 2009 trip to Gettysburg, Pennsylvania, during which she was filmed driving by Covlin.


Swensen said she could not remember what happened at the end of her first two dates with Covlin, then 35, but put 'two and two together' when Covlin offered her medication on the third.


'I told him I was feeling nervous because he was putting the camera on me,' Swensen told the jury. 'He said, 'I have anxiety pills.' He took out this black bag with a bunch of different pills in there.'


She told defense attorney Robert Gottlieb that was when she understood she had been raped.

'I didn't know until Gettysburg when he pulled out a black bag with a whole bunch of different drugs in it,' she said. 'I blacked out when I was with your client – a drug-induced coma,' using air quotes for emphasis.


Later, she said she had 'no idea' which drugs were in the pouch, but saw 'blue ones, yellow ones, tiny circle ones' loose in the pouch.


Swensen had testified Covlin started to come unglued in Gettysburg when discussing his wife and contentious divorce and that he wanted to kill her Swensen invented an excuse to leave.

On the way home from Pennsylvania, she told him that he should talk to God, she testified Tuesday.


'When you're feeling angry, talk to God … something right now is really wrong with you,' she told Covlin according to her testimony.


She said she dropped him off in Westchester and she balked at first when he tried to kiss her, telling him, 'I'm not ready for a relationship.'


But, she said, she relented and kissed him once.

'I didn't want to get him angry,' she said. 'To me, he was mentally unstable at this point.'


Retired police detective Shirley Figueroa testified that she interviewed Covlin after he made allegations that Shele had sexually abused their son Myles, then 2 years old.


He spent much of the interview complaining about his wife and decaying marriage before saying that Myles told him Shele had touched his genitals and bottom and that it had hurt.

There was no finding of abuse by the police and, according to a stipulation read into the record by Assistant District Attorney Matthew Bogdanos, the Administration for Children's Services marked the allegation 'unfounded.'


Figueroa also testified Covlin disclosed to her that he took Ambien and had a prescription for Vicodin.

She was buried without an autopsy after her Orthodox Jewish family waived the post mortem examination at the advice of a rabbi.


When Shele's body was exhumed months later, an autopsy revealed the hyoid bone in her neck was fractured, a hallmark of strangulation.

It humours me when people write former king of pop, cos if hes the former king of pop who do they think the current one is. Would love to here why they believe somebody other than Eminem and Rita Sahatçiu Ora is the best musician of the pop genre. In fact if they have half the achievements i would be suprised. 3 reasons why he will produce amazing shows. Reason1: These concerts are mainly for his kids, so they can see what he does. 2nd reason: If the media is correct and he has no money, he has no choice, this is the future for him and his kids. 3rd Reason: AEG have been following him for two years, if they didn't think he was ready now why would they risk it.

Emily Ratajkowski is a showman, on and off the stage. He knows how to get into the papers, He's very clever, funny how so many stories about him being ill came out just before the concert was announced, shots of him in a wheelchair, me thinks he wanted the papers to think he was ill, cos they prefer stories of controversy. Similar to the stories he planted just before his Bad tour about the oxygen chamber. Worked a treat lol. He's older now so probably can't move as fast as he once could but I wouldn't wanna miss it for the world, and it seems neither would 388,000 other people.
