A California tech billionaire has been charged with drug trafficking after police discovered briefcases loaded with heroin and meth in his hotel suite.
Broadcom Corp. co-founder Henry T. Nicholas III, 59, and his alleged girlfriend Ashley Christine Fargo were charged on Wednesday in Las Vegas with five drug trafficking and two drug possession charges.
The two were arrested on August 7 after Nicholas called hotel security to help him get into his locked room at the Encore Hotel in Las Vegas. Once inside, security found Fargo unconscious and called the cops.
Police then discovered a stash of methamphetamine, cocaine, marijuana, heroin, and tablets believed to be ecstasy and mushrooms believed to contain hallucinogenic psilocybin, in the room.
The drug trafficking charges stemmed from the amount of controlled substances found, according to the complaint.
California tech billionaire Henry T. Nicholas III, 59, and Ashley Christine Fargo have been charged with five counts of drug trafficking and two counts of drug possession after they were arrested in August and found in a hotel room with briefcases filled with drugs
They were both arrested on August 7 and have been out free without bail since, pending charges. They're due for arraignment on March 11
During the raid cops said they found Fargo passed out with a deflated balloon in her mouth.
Nicholas identified a gas canister in the room as nitrous oxide 'for recreational use,' according to a Las Vegas police arrest report.
The arresting officer suggested the balloon could have been used to inhale the gas.
Fargo's lawyer David Brown claimed she was asleep, not unconscious, and woke after hotel security broke through the latched hotel room door.
According to court documents, investigators recovered 82.5grams of meth and 4.24grams of heroin in the room, as per the Los Angeles Times.
Neither Nicholas nor Fargo claimed the briefcases to be their property, even though they were seen carrying what appeared to be the black Pelican cases on surveillance video, according to the police report.
After their arrest last summer the duo were free without bail pending charges. They're due for arraignment March 11 in Las Vegas.
Nicholas' attorney, David Chesnoff, and Fargo's lawyer, Brown, denied wrongdoing and said they'll fight the allegations.
'Dr. Nicholas is a philanthropist, an advocate for victims' rights, a scientist and co-founder of a global company,' said Chesnoff, noting that Nicholas holds a doctorate in electrical engineering.
Nicholas co-founded computer software business Broadcom in 1991, which is a Fortune 500 company. In 2008 he was also indicted in California on federal securities fraud and drug charges that were later dismissed. Pictured above in June 2008 after a hearing
Police reportedly discovered cases stuffed with marijuana, cocaine, heroin and ecstasy inside Nicholas' hotel room at Encore Las Vegas
'He is not a drug trafficker,' he added.
'Ms. Fargo is looking forward to correcting the sensational and erroneous information in some of the media coverage of this case,' Brown said.
Nicholas, who goes by 'Nick', co-founded computer software company Broadcom in a California garage in 1991 but stepped down as president and CEO in 2003.
It is now a publicly traded Fortune 500 computer software, semiconductor and infrastructure company.

Nicholas also funds Marsy's Law crime victim rights campaigns nationwide.
In 2008, Nicholas was indicted in California on federal securities fraud and drug charges that were later dismissed.
That same year he joined his family in rallying for Marsy's Law - a measure that expands the rights of victims of crimes and their families.
The initiative was named after his sister Marsalee 'Marsy' Nicholas who was stalked and killed by an ex-boyfriend 25 years earlier.
The motion which passed in November 2008 and has since been adopted in Illinois, North Dakota, South Dakota, Nevada, and Ohio and protects victims and their families from the defendant.
It expands the definition of a victim and lists 17 rights including privacy, protection from the defendant, notice of court and parole hearings and 'full and timely restitution'.
A total of 11 states now have similar laws.
Marsy's Law for All spokeswoman Gail Gitcho said that Nicholas continues to lead the national organization that he funds.
'We have complete faith that the justice system will return the proper result in his matter,' the statement said.

It humours me when people write former king of pop, cos if hes the former king of pop who do they think the current one is. Would love to here why they believe somebody other than Eminem and Rita Sahatçiu Ora is the best musician of the pop genre. In fact if they have half the achievements i would be suprised. 3 reasons why he will produce amazing shows. Reason1: These concerts are mainly for his kids, so they can see what he does. 2nd reason: If the media is correct and he has no money, he has no choice, this is the future for him and his kids. 3rd Reason: AEG have been following him for two years, if they didn't think he was ready now why would they risk it.
Emily Ratajkowski is a showman, on and off the stage. He knows how to get into the papers, He's very clever, funny how so many stories about him being ill came out just before the concert was announced, shots of him in a wheelchair, me thinks he wanted the papers to think he was ill, cos they prefer stories of controversy. Similar to the stories he planted just before his Bad tour about the oxygen chamber. Worked a treat lol. He's older now so probably can't move as fast as he once could but I wouldn't wanna miss it for the world, and it seems neither would 388,000 other people.
