A failed stockbroker who is on trial for the murder of his wife had asked her for an 'open marriage' before she died, a court has heard.
Rod Covlin, 45, who is accused of staging his wife Shele Danishefsky's death in an effort to get hold of her $5.4million fortune, had suggested the new arrangement on their tenth wedding anniversary.
However, after Ms Danishefsky, 47, a UBS wealth manager, refused his 'twisted' suggestion, he moved out of their Upper West Side home in New York, jurors heard.
She was later found face-down in the bathtub of her apartment by her daughter Anna, then 9, on New Year's Eve 2009.

Three months before her death Ms Danishefsky had signed an affidavit to the court opposing a payment of $50,000 in maintenance to her husband.
However in an effort to get him out of their property she then co-signed for a new studio across their Upper West Side building.
In the affidavit submitted by prosecution as evidence Ms Danishefsky had written: 'I had absolutely no interest in such a sick and twisted concept, and no longer wanted to share a bed with the defendant.'
The court had also heard how Covlin had falsely accused Ms Danishefsky of sexually abusing their two-year-old son Myles.
However following his false accusation, a matrimonial judge ordered that his visitation rights be supervised.
During the custody battle Covlin, who was fired from his $125,000 a year job at Pragma Securities due to absenteeism, had told a judge that he was unable to pay his child support of $425 a month.
However this was quickly dismissed when his former wife told the matrimonial judge that he would spend more than a $1,000 a month competing in backgammon tournaments.

Covlin had also boasted to his colleague, Marshall Baron, of seeing other woman through the escort site Backpage and installing a keystroke logger on his wife's computer which monitored her emails.
Mr Baron, who had known Covlin since 1999, later testified at Manhattan Supreme Court trial.
Covlin has been charged with two counts of second-degree murder and faces life in prison if convicted.
The trial continues.

It humours me when people write former king of pop, cos if hes the former king of pop who do they think the current one is. Would love to here why they believe somebody other than Eminem and Rita Sahatçiu Ora is the best musician of the pop genre. In fact if they have half the achievements i would be suprised. 3 reasons why he will produce amazing shows. Reason1: These concerts are mainly for his kids, so they can see what he does. 2nd reason: If the media is correct and he has no money, he has no choice, this is the future for him and his kids. 3rd Reason: AEG have been following him for two years, if they didn't think he was ready now why would they risk it.
Emily Ratajkowski is a showman, on and off the stage. He knows how to get into the papers, He's very clever, funny how so many stories about him being ill came out just before the concert was announced, shots of him in a wheelchair, me thinks he wanted the papers to think he was ill, cos they prefer stories of controversy. Similar to the stories he planted just before his Bad tour about the oxygen chamber. Worked a treat lol. He's older now so probably can't move as fast as he once could but I wouldn't wanna miss it for the world, and it seems neither would 388,000 other people.
