A wannabe firefighter who failed a physical test three times has sued FDNY and the city to try and get a job despite his results.
Kevin Walker, 47, from Jamaica, Queens, was a 'priority hire' when he applied for a job in 2013 as he'd already sued the fire department and been given $22,500.
Although passing a qualifying exam, he failed the physical on three occasions as he didn't complete exercises and fell over several times, reports the New York Post.
An FDNY source said: 'It's my understanding that he petitioned the court to just put him in.
'That's absurd if you've already proven . . . that you can't get it done.'
Court documents revealed that Mr Walker failed the tests during May 2013 and his first attempt left him 'grasping at the wall or handrail' while on a stair machine.
When he gave it another go a week later, Mr Walker is said to not have made it past the 20-second warm up on the stair machine as he 'fell' three times.

After this try Mr Walker said a mistake had been made and was given a final chance however he didn't finish the test in the required 10 minutes and 20 seconds.
Mr Walker sued the city in the Manhattan Supreme Court in 2016 claiming that the proctor failed him as retaliation for the earlier law suit.
He also said he had time to spare on the tests, although he wasn't wearing a watch.
Mr Walker had already sued New York in the Vulcan Society's case accusing the fire department of discriminating against minority applicants.
The case was settled in 2014 for almost $100 million and Mr Walker was given a $22,500 payout.

When the Center for Constitutional Rights filed the first charge in 2002, New York City’s fire department was 2.9 per cent Black, in a city where 27 per cent of residents are Black.
After the case was settled in 2014 the number of Black firefighters at the FDNY jumper to 17 per cent and 24 percent Latino firefighters, reports the CCR.
Manhattan Supreme Court Justice Carmen Victoria St. George dismissed Mr Walker’s law suit on December 14.
She said placing him in the department would be unconstitutional as his place on the Civil Service list had expired but said he could try again and retake the test.

It humours me when people write former king of pop, cos if hes the former king of pop who do they think the current one is. Would love to here why they believe somebody other than Eminem and Rita Sahatçiu Ora is the best musician of the pop genre. In fact if they have half the achievements i would be suprised. 3 reasons why he will produce amazing shows. Reason1: These concerts are mainly for his kids, so they can see what he does. 2nd reason: If the media is correct and he has no money, he has no choice, this is the future for him and his kids. 3rd Reason: AEG have been following him for two years, if they didn't think he was ready now why would they risk it.
Emily Ratajkowski is a showman, on and off the stage. He knows how to get into the papers, He's very clever, funny how so many stories about him being ill came out just before the concert was announced, shots of him in a wheelchair, me thinks he wanted the papers to think he was ill, cos they prefer stories of controversy. Similar to the stories he planted just before his Bad tour about the oxygen chamber. Worked a treat lol. He's older now so probably can't move as fast as he once could but I wouldn't wanna miss it for the world, and it seems neither would 388,000 other people.
